Mediation

Mediation is a process by which parties in dispute agree to retain the services of a Mediator, also known as a Neutral, to assist in the resolution of their dispute. Mediation is distinguished from Arbitration and Non-Binding Arbitration in that in Mediation the parties can be the architects in the crafting of the resolution of their own dispute.

Arbitration

While Mediation permits the parties to create a space for self-determination
and creativity, Arbitration is quite different. Arbitration is a process by which
the parties agree to have a third party, a Neutral, preside over their case with
the understanding that said third party or Neutral will ultimately decide the
outcome of the dispute. Arbitrators are similar to judges in that they both
rule on the dispute, and with limited exception, are considered binding upon
the parties.

Non-Binding Arbitration

Non-Binding Arbitration is governed by Chapter 44, Florida Statutes, and is another process available to parties who seek resolution of their dispute. This process allows each party to present their case before an Arbitrator. The Arbitrator will opine on how he or she will likely rule. The parties can either accept or reject the Arbitrator’s decision. If the parties agree, the Arbitrator drafts the award as indicated. Unlike in Arbitration, Non-Binding Arbitration permits a party to reject the Arbitrator’s ruling, and get back on track towards the path of litigation, and ultimately to trial.

EEO Investigation

When allegations of discrimination occur, the employer must ensure that a proper and thorough investigation is underway, and done so in a timely and effective manner. Claims of workplace discrimination are a serious matter that often requires the investigation and assistance of a third party. This third party, typically, an EEO Investigator, is retained to investigate the claim(s) of employment discrimination, and once investigated, to prepare an investigative report. A well-trained professional understands the necessity of handling such sensitive matters in both a confidential and proper manner. It is also important when investigating claims of discrimination, that serious consideration is given to legal requirements to ensure compliance and that any action taken is properly documented.
